Progressive Illness

Q: I am a partner in a large practice with nine dentists and 48 staff. A long term dental assistant has a progressive illness that is starting to impact her ability to do her job. She is often absent, has difficulty performing the work, struggles with handling the instruments and even has difficulty walking. I am concerned for her safety. I am also concerned with the quality of service she is providing our patients. She is doing the job but just barely. What should I do? Can we terminate her? This is truly heartbreaking.

Posters Requirements

Q: I am continually receiving phone calls from people trying to sell me employment labor law posters. What posters do I actually need? How often should I replace them and where should they be hung? What will happen if I they are not current? I feel like the try to scare me into a purchase.

A: There are a number of mandated posters that employers are required to have posted in an openly accessible location for employees to read. These posters are designed to notify employees of their employment rights. You can get most or all via the internet for free through the government, this will give you the posters but you will have a messy conglomerate covering a wall. It tends to more time effective and neater to buy them.

Benefit for part-time staff

Q: As my practice has grown, I have increased the number of employees. I now utilize full-time (40 hours a week) and part-time employees who work a variety of hours per week – 32 hours, 20 hours and one works one day a week.

My benefit package is set up only for full-time employees and my other staff members would like some of these benefits. I would be willing to provide them but I would like to set it up so that the benefits are proportionate to the hours they work. Is there any way I can do this and if so how?
